Terms and conditionsThese terms explain how purchases from Ultramarathon Running Store work. They set out your rights and responsibilities, together with ours, and should be read alongside our Delivery and returns and Privacy policy pages. We aim to keep ordering straightforward and transparent. If something does not go to plan, we will work with you to resolve it fairly and in accordance with UK consumer law. About usUltramarathon Running Store is the trading name of ULTRAMARATHONRUNNING Ltd, an independent UK online retailer. Products shown as available are held in our own UK stock and dispatched from our Bristol warehouse. We do not operate a marketplace and orders are not fulfilled by third-party sellers. Legal name: ULTRAMARATHONRUNNING Ltd Company number: 07999385 VAT number: 131 2908 42 Registered in: England and Wales Registered office: 2 Minton PlaceVictoria Road Bicester Oxfordshire OX26 6QB United Kingdom Using this websiteBy using this website, you agree to do so lawfully and in accordance with these terms. You must not use the website in a way that may damage, interrupt or impair its operation, compromise its security, or interfere with another person's use of it. You must not attempt to gain unauthorised access to the website, its systems, customer accounts or any data connected with it. You must not introduce viruses, malicious code or other material that may damage the website or its users. You are responsible for keeping your account details and password secure. Please contact us promptly if you believe that your account has been used without your permission. Placing an orderWhen placing an order, you confirm that the information you provide is accurate and complete and that you are authorised to use the selected payment method. Before placing your order, you will be shown the products selected, their prices, applicable taxes, delivery charges and the total amount payable. You will also have an opportunity to identify and correct input errors. By using the final order button at checkout, you acknowledge that placing the order creates an obligation to pay, subject to our acceptance of the order. After you submit an order, we will send an email acknowledging the products ordered, the delivery details and the amount payable. This email confirms that we have received your order. It does not by itself mean that we have accepted it. Please check your order confirmation carefully and contact us as soon as possible if any details are incorrect. Order acceptanceYour order is an offer to purchase goods from us. A contract between you and ULTRAMARATHONRUNNING Ltd is formed when we accept your order by dispatching the goods and sending you a dispatch confirmation. Occasionally, we may be unable to accept an order. This may happen because:
If we cannot accept your order, we will let you know and will not charge you for the goods. If payment has already been taken, it will be refunded to the original payment method. We will provide confirmation of the contract and the information required by law by email or in another format that you can save. This will be provided no later than when the goods are delivered. PaymentPayment must be made using one of the payment methods offered at checkout. Payment is subject to validation and authorisation by your payment provider. If your payment provider does not authorise the transaction, we will be unable to accept or dispatch your order. We are not responsible for delays caused by payment validation or authorisation checks. The timing of payment may vary depending on the payment method used. Payment may be authorised when the order is placed and collected when the goods are prepared for dispatch. Optional additional products or services will not be added to your order without your express agreement. Prices and product informationPrices are shown in pounds sterling and include VAT where applicable, unless clearly stated otherwise. Delivery charges, where applicable, are shown during checkout before you place your order. We take reasonable care to ensure that product descriptions, sizes, images and prices are accurate. Measurements and sizing information are provided as a guide and may vary slightly between products and manufacturers. Product colours may appear slightly different depending on the screen, device or browser used to view them. Occasionally, a product may be listed with an incorrect price or description. Where an error is obvious and could reasonably have been recognised as a mistake, we may cancel the order or contact you to ask whether you wish to continue at the correct price. If we cancel an order after payment has been taken, we will issue a full refund to the original payment method. Stock availabilityEverything shown as available is normally held in stock at our Bristol warehouse. Stock levels are updated as orders are placed, but on rare occasions an item may become unavailable before the website updates. If this happens, we will contact you as soon as possible. We may offer an alternative, arrange a later dispatch where appropriate, or cancel and refund the unavailable item. We may change or withdraw products from sale at any time, but this will not affect an order that we have already accepted. DeliveryAvailable services, delivery charges, estimated delivery times, international shipping terms and other current delivery information are set out on our Delivery and returns page. Delivery estimates begin when an order is dispatched. They are estimates unless the selected service is expressly described as guaranteed. Unless we agree a different delivery period with you, we will deliver your order without undue delay and no later than 30 days after the contract is formed. If we fail to deliver within an agreed essential delivery period, or within an additional reasonable period provided by you where applicable, you may have the right to cancel the contract and receive a refund. You are responsible for providing a complete and accurate delivery address. We may charge reasonable additional delivery costs where an order has to be resent because the address supplied was incomplete or incorrect, or where delivery could not be completed for reasons within your control. Responsibility for the goods passes to you when they are delivered to you, or to a person identified by you to receive them. Ownership passes to you once we have received payment in full. International ordersInternational orders are supplied on the basis stated on our Delivery and returns page. Unless otherwise stated at checkout, international orders are sent DAP, which means Delivered at Place. The recipient is responsible for any import duties, taxes, customs charges or local handling fees. Customs processes and local delivery services are outside our direct control and may affect delivery times. If you live outside England and Wales, you may also have mandatory rights under the consumer law of the country in which you live. Nothing in these terms removes any consumer protection that cannot legally be excluded. CancellationsBefore dispatchTo cancel or amend an order before dispatch, contact us as soon as possible. We will try to stop the order, but this may not be possible if it has already been prepared or collected. Your statutory right to cancelIf you are purchasing as a consumer, you normally have the right to cancel an online purchase without giving a reason. The cancellation period ends 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods. For an order containing several goods delivered separately, the cancellation period normally ends 14 days after the day on which the final item is received. To exercise this right, you must tell us clearly that you wish to cancel. You can do this by email, through our contact form, by live chat or in writing. You may use the model cancellation form at the end of these terms, but you are not required to use it. You must send the cancellation notice before the 14-day cancellation period expires. You must then return the goods without undue delay and no later than 14 days after telling us that you are cancelling, unless we have agreed another arrangement with you. Exceptions to the right to cancelThe statutory right to cancel may not apply to:
Our voluntary 100-day returns policy gives you longer to return most eligible products. Full conditions and instructions are available on our Delivery and returns page. Returns and refundsIn addition to your statutory rights, we offer a 100-day returns period for eligible products. Returned goods must meet the conditions shown on our Delivery and returns page, including being unused, clean, in perfect condition and returned with their original packaging and labels. UK returns are free when made using the return method supplied or authorised by us. International customers are responsible for return postage unless the goods are faulty, damaged or incorrectly supplied. If you cancel under your statutory cancellation rights, we will refund the price paid for the returned goods and the cost of our least expensive standard delivery service offered at the time of your order. If you selected a more expensive delivery service, we are not required to refund the additional cost above our least expensive standard service. We will make the refund without undue delay and no later than 14 days after the earliest of:
If no goods were supplied, the refund will be made no later than 14 days after the day on which you informed us of your decision to cancel. We may make a reasonable deduction from a refund where the value of the goods has been reduced because they have been handled beyond what would reasonably be necessary to establish their nature, characteristics and function. You may inspect goods in the same way that you would reasonably be permitted to inspect them in a shop. Using products outdoors, wearing footwear beyond an indoor fitting, washing products, removing hygiene seals or otherwise using goods beyond a reasonable inspection may reduce their value. Refunds are made to the original payment method unless we expressly agree otherwise. You will not be charged a fee for receiving the refund. Full return instructions, return conditions and current processing times can be found on our Delivery and returns page. Faulty, damaged or incorrect goodsGoods must be of satisfactory quality, fit for their normal purpose, suitable for any particular purpose made known to us before purchase and as described. Nothing in these terms or in our voluntary returns policy limits your rights under the Consumer Rights Act 2015 or any other applicable consumer law. Depending on the circumstances, your legal rights may include:
The short-term right to reject faulty goods will normally apply for 30 days from delivery. Different rules and time limits may apply to perishable goods. If a fault becomes apparent within six months of delivery, it will generally be presumed to have been present at delivery unless we can show otherwise or that presumption would be inconsistent with the nature of the goods or fault. If a fault becomes apparent after six months, you may be asked to provide evidence that the fault was present when the goods were supplied. If an item arrives damaged, is faulty or is not what you ordered, please contact us with your order number and details of the problem. We may ask for photographs or for the item to be returned so that it can be inspected. Where a fault or fulfilment error is confirmed, we will provide an appropriate remedy in accordance with your legal rights. We will also cover reasonable return costs using a return method supplied or agreed by us. A manufacturer's warranty or guarantee is additional to your statutory rights and does not replace or restrict them. Promotions and discount codesPromotions may be subject to additional conditions shown with the offer. Those conditions form part of these terms. Unless the promotion states otherwise:
We may withdraw or amend a promotion where reasonably necessary, but this will not affect an order that we have already accepted under that promotion. We may refuse or cancel the use of a promotion where we reasonably believe it has been used fraudulently, contrary to its conditions or as the result of an obvious error. Any price comparison, saving, stock statement, closing date or other promotional claim will be presented in accordance with applicable consumer protection law. Gift vouchers and certificatesGift vouchers and certificates can be redeemed online at ultramarathonrunningstore.com using the code provided.
The expiry date will be displayed before purchase and included with the voucher or purchase confirmation. Please keep the code secure. We are not responsible for a voucher that is lost, stolen or used without the purchaser's permission, unless this results from something we have done wrong. Our responsibility to youWe are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. A loss is foreseeable if it was an obvious consequence of the breach or if both you and we knew it might happen when the contract was formed. Where such an event affects your order, we will take reasonable steps to reduce the effect of the delay and keep you informed. If there is a substantial delay, you may contact us to cancel the affected order and receive a refund for goods that you have paid for but have not received. Your statutory rights remain unaffected. ComplaintsIf you are dissatisfied with a product or our service, please contact us using the details below. Please include your order number and a clear description of the issue. Changes to these termsWe may update these terms from time to time to reflect changes to the website, our services, our business practices or applicable law. The terms applying to your purchase will normally be those published when you place the order.
